Faysal Moqalled was released!


                                                                                                

Beirut, Paris, Lyon, Copenhagen – February 10, 2017 - Our organizations welcome the release on Sunday 5 February of Faysal Ghazi Moqalled, who spent 11 years in arbitrary detention. 
On October 2016, the Military Court of Cassation reconsidered his life sentence for collaborating with the enemy –  a judgement based on confessions extracted under torture – commuting the sentence down to fourteen years’ imprisonment (9-month custodial years).
Our organizations, however, strongly condemn the unfairness of the decision which did not take into account any of the several violations throughout proceedings that jeopardized the case (including 2 years in detention with no access to lawyer), the serious ill-treatment and torture inflicted on Faysal Moqalled (resulting in knocked-out teeth and several injuries), the intervention of the United Nations Special rapporteur on torture towards the Lebanese government, nor any of the exculpatory evidence.
All of these elements should have led to the outright annulment of the trial in first instance, bringing those responsible of torture to justice and granting compensation to Mr. Moqalled for the harm suffered.

Beyrouth, Paris, Lyon, Copenhague – le 10 février 2017 - Nos organisations saluent la libération dimanche 5 février de Faysal Ghazi Moqalled, au terme de onze années de détention arbitraire.
 En octobre 2016, la Cour de Cassation Militaire avait en effet revu sa condamnation à perpétuité pour collaboration avec l'ennemi - qui se basait exclusivement sur des aveux arrachés sous la torture - commuant sa peine en 14 ans de prison (années carcérales de 9 mois).
Nos organisations condamnent toutefois fermement l'iniquité de cette décision qui n'a pas pris en compte les violations de procédures qui ont entaché l'affaire (notamment les deux ans de détention sans accès à un avocat), les tortures gravissimes que Faysal Moqalled a subies (et qui ont résulté dans la fracture de ses dents et des lésions diverses), l’intervention du rapporteur spécial sur la torture des Nations Unies auprès du gouvernement libanais, ni l'ensemble des preuves à décharge.
L'ensemble de ces éléments aurait dû conduire à une annulation pure et simple du procès en première instance, à des poursuites contre ses tortionnaires et à des indemnités versées à M. Moqalled en compensation du préjudice subi.

ليون، بيروت، باريس، كوبنهاغن، في 10 شباط 2017 - ترحب منظماتنا بالإفراج عن فيصل غازي مقلد الأحد ٥ شباط بعد أحد عشر عام من الإحتجاز التعسفي.
في تشرين الأول ٢٠١٦ أعادت محكمة التمييز العسكرية النظر في الحكم مؤبداً بتهمة التعاون مع العدو - الذي كان يستند حصرا على اعترافات انتزعت تحت التعذيب - فخففت العقوبة إلى ١٤ سنة (سنة سجنية، ٩ أشهر).
رغم تخفيف الحكم، فإن منظماتنا تدين بشدة عدم عدالة هذا القرار الذي لم يأخذ في عين الاعتبار الانتهاكات الإجرائية التي شوهت القضية (بما في ذلك عامين من الاعتقال من دون الحصول على محامي)، التعذيب الشديد الذي تعرض له فيصل مقلد (والذي أسفر عن كسر في أسنانه و جروحات متعددة)، وتدخل المقرر الخاص المعني بالتعذيب التابع للأمم المتحدة مع الحكومة اللبنانية ولا عن كل أدلة البراءة التي قدمت للمحكمة.
كان ينبغي على تلك العوامل أن تؤدي إلى إلغاء صريح للقرار الأولي و إلى ملاحقة معذبيه و إلى دفع تعويضات للسيد مقلد لجبرالضرر الذي كان ضحيته.

CLDH delegation raises the case of Faysal Moqalled with Lebanese President Michel Sleiman


A delegation of the Lebanese Center for Human Rights (CLDH) visited today General Michel Sleiman, President of Lebanon, in order to thank him for his personal stand against the deportation of Syrian refugees and expose to him the current concerns of the organization.

CLDH raised with the President (...) the case of Faysal Moqalled, sentenced to life imprisonment on the basis of unbelievable « confessions » that he reportedly signed under the torture of the Lebanese Army intelligence services at the Ministry of Defense. A detailed report about this case, showing the file’s inconsistencies as well as the violations to which Faysal Moqalled was allegedly subjected was delivered by hand to the President.

إنّ الأدلة تُثبت عكس ذلك، لقد تعرّض للتعذيب بشدة من أجل التوقيع على إعترافات لم يُعطى الفرصة لقراءتها،

الإفراج عن أربعة أشخاص متهمين بالعمالة يثير الاعتراضات
إنّ المركز اللبناني لحقوق الإنسان يدعو المسؤولين السياسيين إلى دعم نزاهة العدالة.

يَطلب المركز اللبناني لحقوق الإنسان من المسؤولين السياسيين، عدم الضغط على القضاة عندما يتوجب عليهم تطبيق القانون لجهة إطلاق سراح الأشخاص الذين ينتظرون المحاكمة.
يدين المركز اللبناني لحقوق الإنسان بشدة، موجة الاحتجاجات التي أعقبت قرار رئيسة محكمة التمييز العسكرية "القاضية أليس شبطيني" بإطلاق سراح أربعة أشخاص من آل العلم، الذين كانوا قد حُكم عليهم بالسجن من قبل المحكمة العسكرية الدائمة بتهمة العمالة.
بل على العكس، إنّ المركز اللبناني يرحّب بهذا القرار، ويشجّع القضاة لاتخاذ قرارات بالإفراج عن أكثر عدد من المعتقلين وفقا للقانون اللبناني ودون أي إعتبار للتدخل السياسي الغيرمقبول في عمل العدالة.
إنّ الميثاق الدولي الخاص بالحقوق المدنية والسياسية، الذي يشكل لبنان طرفا فيه ينص أيضا في المادة 9 على أنّه "لا يجوز أن يكون إحتجاز الأشخاص الذين ينتظرون المحاكمة هو القاعدة العامة، ولكن من الجائز تعليق الإفراج عنهم على ضمانات لكفالة حضورهم المحاكمة في أية مرحلة أخرى من مراحل الإجراءات القضائية، و لكفالة تنفيذ الحكم عند الاقتضاء". من غير المجدي التذكير بأنّ لبنان دولة طرف في الاتفاقية منذ عام 1972، و ملتزم بتطبيقها.
إضافة إلى ذلك، يشوب عدد من القضايا الحالية، إنتهاكات كبيرة لجهة حقوق المتهمين في الحصول على محاكمة عادلة: التحقيقات بطريقة مخالفة للقانون اللبناني، التعذيب، تجاوز المدة القانونية في التوقيف الإحتياطي والمحاكمات الجائرة أمام المحكمة العسكرية الدائمة............
على سبيل المثال، ألقي القبض على فيصل غازي مقلد، 34 عاماً، في شباط 2006، وأعتقل خمسة أشهر في سجن لحزب الله، قبل أن يتم تسليمه إلى مخابرات الجيش. يُعاني حاليا من مشاكل نفسية وجسدية من جرّاء التعذيب الذي تعرّض له أثناء احتجازه عشرون شهرا تحت الأرض في وزارة الدفاع. من بين عدة أمور، ستة من أسنانه الأماميات تمّ تكسيرهم. بناءً على إعترافاته التي على الأرجح انتزعت منه تحت التعذيب، أًدين فيصل مقلد في عام 2009 من قبل المحكمة العسكرية الدائمة بالسجن مدى الحياة للتعامل مع إسرائيل. وبالمثل، فإنّ المهندس طارق ربعة، 41 عاما، اعتقل في تموز 2010، وتعرّض للتعذيب ولسوء المعاملة لمدة 108 يوما في وزارة الدفاع ( تمّ توثيقها من قبل الطبيب الشرعي )، هو الآن يخضع للمحاكمة أمام المحكمة العسكرية الدائمة بتهمة التعامل مع اسرائيل، على أساس وثائق المخابرات التي كان ينفي دائما صحّتها و توقيعها، حتّى تحت التعذيب.
تعطي هذه الانتهاكات لاحتجاز الكثير من المتهمين، طابعاً تعسفياً يوجب تطبيق نظام قضائي عادل يأخذ بعين الاعتبار هذه الانتهاكات ولا سيما عن طريق الإفراج عن أشخاص كلما أمكن ذلك.
إنَ الاحتجاجات التي رافقت الإفراج عن أربعة أشخاص من آل العلم، تُعيد إلى الأذهان التدخل السياسي الذي وقع خلال إحتجاز الضباط الأربعة وعدد من المدنيين في سياق التحقيق في جريمة اغتيال رئيس الوزراء رفيق الحريري، والذين أفرج عنهم أخيرا بعد سنوات من الاعتقال التعسفي في أعقاب قرار للمحكمة الخاصة للبنان. في هذه القضية، تعرّض أيضا القضاة لضغوط سياسية لرفض الإفراج عن المتهمين الذين ينتظرون المحاكمة.

Disputed decision to release on bail four alleged spies
CLDH urges the politicians to support the equity of the Judiciary

CLDH (Lebanese Center for Human Rights) urges the politicians to refrain from exerting any pressure on the judges who decide, abiding by the law, to release persons on bail pending their trial.

CLDH firmly condemns the protests raised by some politicians following the decision of the President of the Military Court of Appeals Alice Chebtini to release on bail, pending their trial in appeal, four members of Alam family who had been sentenced to prison terms for espionage by the Permanent Military Court.

On the contrary, CLDH welcomes this decision and encourages all judges to take the decision to release as many detainees as possible, in accordance with the Lebanese law and without taking into account any of the political interferences that are unacceptable within the judicial process.

The international covenant on civil and political rights thus provides in its article 9 that «it shall not be the general rule that persons awaiting trial shall be detained in custody, but release may be subject to guarantees to appear for trial, at any other stage of the judicial proceedings, and, should occasion arise, for execution of the judgement». There is no need to reiterate that Lebanon has ratified this covenant since 1972 and is bound to apply it.

Moreover, many ongoing cases are marred by gross violations of the right of the accused to a fair trial: investigations conducted in contradiction with the Lebanese law, torture, exceeded statutory period of pretrial detention, unfair trials in front of the Permanent Military Court...

Thus for example Faysal Ghazi Moqalled, 34 years old, was arrested in February 2006 and detained for 5 months in a Hizbullah prison before being handed over to the military intelligence services. Today, he is still suffering from the psychological and physical aftermath of torture he was allegedly subjected to during his 20-month detention in the underground of the Ministry of Defense.  Six of his front teeth are broken. On the basis of his confessions that are likely to have been signed under torture, Faysal Moqalled was sentenced in 2009 by the Permanent Military Court to life imprisonment for collaboration with Israel. Likewise, Engineer Tarek Omar Rabaa, 41 years old, arrested in July 2010 and who was allegedly subjected to 108 days of torture and ill-treatment in the Ministry of Defense (certified by a forensic doctor), is facing trial in front of the Permanent Military Court for collaboration with Israel on the basis of documents provided by the intelligence services, the content of which Mr. Rabaa has always been denying and that he allegedly refused to sign even under torture.

The above-mentioned violations are so serious as to confer on the detention of large numbers of detainees in Lebanon an arbitrary character that a fair Judiciary has to take into consideration, namely by releasing the detainees every time possible.

The protests concerning the release of four members of Alam family are reminiscent of the political interferences that occurred during the detention of four generals and several civilians in the framework of the investigation into the assassination of Prime Minister Rafic Hariri, and who were finally released after years of arbitrary detention following a decision of the Special Tribunal for Lebanon. In that case, the investigating judges were also allegedly subjected to political pressure aiming at preventing them from taking any decision to release the detainees pending their trial.

Remise en liberté contestée de quatre espions présumés
Le CLDH appelle les responsables politiques à soutenir l’équité de la Justice


Le CLDH (Centre Libanais des Droits Humains) demande instamment aux responsables politiques de ne pas exercer de pressions sur les magistrats lorsque l’application des lois leur dicte de remettre en liberté des personnes dans l’attente de leur jugement.
 

Le CLDH condamne fermement la vague de protestations de la part de certains responsables politiques qui a suivi la décision de la Présidente de la Cour de cassation militaire Alice Chebtini de remettre en liberté, dans l’attente de leur jugement en cassation, quatre membres de la famille Alam qui avaient été condamnés à des peines de prison par le Tribunal militaire permanent pour des faits d’espionnage.

Au contraire, le CLDH salue cette décision, et encourage tous les magistrats à prendre des décisions de remise en liberté en faveur d’un maximum de détenus, conformément à la loi libanaise et sans tenir compte des interférences politiques, inacceptables dans le cadre du travail de la Justice.

Le Pacte international relatif aux droits civils et politiques auquel le Liban est partie prévoit d’ailleurs dans son article 9 que « la détention de personnes qui attendent de passer en jugement ne doit pas être de règle, mais la mise en liberté peut être subordonnée à des garanties assurant la comparution de l'intéressé à l'audience, à tous les autres actes de la procédure et, le cas échéant, pour l'exécution du jugement». Inutile de rappeler que le Liban est partie à ce pacte depuis 1972 et tenu de l’appliquer.

De plus, de nombreuses affaires en cours sont entachées de violations majeures des droits des accusés à un procès équitable : investigations menées dans des conditions contraires à la loi libanaise, torture, dépassement de la durée légale de la détention provisoire, jugements inéquitables devant le tribunal militaire permanent ...

Ainsi par exemple Faysal Ghazi Moqalled, 34 ans, a été arrêté en février 2006 et détenu 5 mois dans une prison du Hezbollah avant d’être remis aux services de renseignements de l’armée. Il souffre aujourd’hui des séquelles psychologiques et physiques des tortures qu’il aurait subies durant sa détention de 20 mois dans le sous-sol du Ministère de la Défense.  Entre autres, six de ses dents de devant sont cassées. Sur la base de ses aveux vraisemblablement signés sous la torture, Faysal Moqalled a été condamné en 2009 par le tribunal militaire permanent à la prison à perpétuité pour collaboration avec Israël. De même, l’ingénieur Tarek Rabaa, 41 ans, arrêté en juillet 2010 et qui aurait subi 108 jours de tortures et de mauvais traitement au Ministère de la Défense (qui ont été attestés par l’expertise d’un médecin légiste), est en cours de procès devant le tribunal militaire permanent pour collaboration avec Israël sur la base de documents des services de renseignements dont il aurait toujours réfuté l’exactitude et qu’il aurait refusé de signer même sous la torture.

Ces violations confèrent à la détention de nombreux prévenus un caractère arbitraire dont un système judiciaire équitable se doit de tenir compte, notamment en procédant à des remises en liberté chaque fois que possible.

Les protestations sur la libération des quatre membres de la famille Alam ne sont pas sans rappeler les interférences politiques qui ont eu lieu au cours de la détention de quatre généraux et plusieurs civils détenus dans le cadre de l’enquête sur l’assassinat du Premier Ministre Rafic Hariri, et qui ont finalement été remis en liberté après plusieurs années de détention arbitraire suite à une décision du tribunal spécial pour le Liban. Dans cette affaire, les juges d’instruction auraient également été soumis à des pressions politiques pour rejeter toute remise en liberté des prévenus en attente de leur jugement.

Faysal Moqalled interrogated and mistreated again in the Ministry of Defense Detention Center


Our organizations strongly denounce the arbitrary transfer of Faysal Moqalled from Roumieh Central Prison to the Ministry of Defense Detention Center for three days for intimidation purposes. On the morning of October 13, agents from the Ministry of Defense reportedly arrived in military vehicles in the central prison in Roumieh and would have taken  Faysal Moqalled to the Ministry of Defense. The legal basis for this transfer is unknown ashis lawyer was not notified. Throughout the transportation, he would have been blindfolded with his head pushed down.

Kept for three days in the underground detention center of the Ministry of Defense on October 13, 14 and 15,
 Faysal Moqalled was allegedly interrogated for six hours, blindfolded, and according to available information, the questions focused on the allegations of torture he was subjected to which were made public by different human rights organizations. This investigation would have had a purpose of intimidation on a person whose trial on appeal is ongoing. FaysalMoqalled was reportedly slapped several times and would have received a punch in the back. His lawyer was not notified of his transfer and was therefore not attending the interrogation.

Faysal Moqalled, kidnapped in February 2006 by Hezbollah who allegedly held him for five months before handing him over to the military intelligence, would have already suffered severe torture and degrading detention conditions at the Ministry of Defense for 20 months before being transferred to Roumieh prison.

Faysal Moqalled, who allegedly suffers from severe asthma since the torture he suffered and has a concerning psychological situation, sees his health deteriorating day after day.

Our organizations strongly denounce the violations
 Faysal Moqalled was subjected to, and allegedly continues to suffer to this day, and remind Ministers of Justice, Interior and Defense of their obligation to protect detainees against torture and other forms of pressure and to ensure the physical and psychological integrity of Faysal Moqalled.

Faysal Moqalled à nouveau interrogé et maltraité au Centre de Détention du Ministère de la Défense

  
Nos organisations dénoncent fermement le transfert arbitraire de Faysal Moqalled de la prison centrale de Roumieh au Centre de Détention du Ministère de la Défense pendant trois jours à des fins d’intimidation. Le 13 octobre au matin, des agents du Ministère de la Défense seraient arrivés en véhicule militaire à la prison centrale de Roumieh et auraient emmené Faysal Moqalled au Ministère de la Défense. La base légale de ce transfert n’est pas connue, son avocat n’en ayant pas été notifié. Durant tout le trajet, celui-ci aurait eu les yeux bandés et la tête poussée vers le sol.

Gardé trois jours au Centre de Détention souterrain du Ministère de la Défense, les 13, 14 et 15 octobre, Faysal Moqalled aurait été interrogé durant 6 heures, les yeux bandés, et selon les informations disponibles, les questions portaient essentiellement sur les allégations de torture le concernant et rendues publiques par différentes organisations de défense des droits de l’Homme. Cet interrogatoire aurait donc eu une visée d’intimidation sur une personne dont le procès en appel est en cours. Faysal Moqalled aurait été giflé à plusieurs reprises et aurait reçu un coup de poing dans le dos. Son avocat n’avait pas été prévenu de son transfert et n’assistait donc pas à cet interrogatoire.

Faysal Moqalled, enlevé en février 2006 par le Hezbollah qui l’aurait détenu pendant 5 mois avant de le remettre aux services de renseignements militaires, aurait déjà subi de graves tortures et des conditions de détention dégradantes au Ministère de la Défense pendant 20 mois avant son transfert à la prison de Roumieh. Faysal Moqalled, qui souffrirait d’un asthme assez sévère suite aux tortures qu’il a subies, et d’une situation psychologique inquiétante voit sa santé se détériorer de jour en jour.

Nos organisations dénoncent fermement les violations dont Faysal Moqalled a fait l'objet, et qu'il continuerait de subir à ce jour ,et rappellent aux ministres de la Justice, de l’Intérieur et de la Défense leur obligation de protéger les personnes détenues contre la torture et toute autre forme de pression, et d'assurer l'intégrité physique et psychologique de Faysal Moqalled.

قضية مقلد : إدعَاءات بالاحتجاز غير القانوني والخضوع لأعمال التعذيب


إن المنظمات الموقعة لهذا النداء تبدي للسلطات السياسية والقضائية اللبنانية إنشغالها الشديد لحالة السيد فيصل غازي مقلد البالغ من العمر 32 عاماً والذي ستبدأ محاكمته بتاريخ 24 تشرين الثاني 2009  أمام محكمة التمييز العسكرية في بيروت والذي يُحتمل أن يكون قد خضع لأعمال تعذيب  بهدف إجباره التوقيع على اعترافاته.

وفقاً للمعلومات التي وردتنا، من المُحتمل أن يكون السيد مقلد قد أوقف بشكل غير قانوني لمدة خمسة أشهر في سجن تابع لحزب الله (من شهر شباط 2006 حتى شهر تموز 2006 ) حيث يُعتقد أنه خضَع لأعمال تعذيب هدفها إجباره على الإعتراف بأنه عميل تابع للموساد الاسرائيلي . وقد أوقف بعد ذلك لمدة 20 شهراً في وزارة الدفاع ( أي حتى 26 آذار 2008 ) حيث يُحتمل أن يكون تعرّض مجدداً للتعذيب.

فيصل غازي مقلد يُعاني حالياً  من ألم في الظهر. أصابعه تبدوا كأنها قد كُسرت فضلاً عن ستة من أسنانه الأمامية. بالإضافة إلى ذلك ، إنه يُعاني من صَدمة نفسية حَادة ناجمة عن ألأنتهاكات التي واجهها وزعم أنه تعرض للصعق بالصَدمات الكهربائية ولتمثيل عملية إعدامه إختناقاً بالغاز، والتعليق على البلانكو ( اليدان مُكبلتان خلف ظهره ، يتم تعليق الضحية من السقف باستخدام بكرة) ، والفلاقة (التعرض للضرب المتكرر على باطن القدمين) ، والتهديد بالإغتصاب، كما واجه العديد من الإهانات والحرمان.

جَرى إستجوابه للمرة الأولى في جلسة أمام قاضي التحقيق بتاريخ 5 آب 2006 من دون حُضور مُحاميه. وحَسبَ مَصادرنا، بأنه خضع للتعذيب بواسطة سَجانيه، إنتقاماً منه (وأخضعوه للتعذيب مجدداً بشكلٍ وحشي بواسطة البلانكو) وذالك بعدما تكلم عن تعذيبه أمام قاضي التحقيق.

في 31 تموز 2009 حُكم عليه بالسجن المؤبد من قبل المحكمة العسكرية الدائمة للأسباب التالية:
-        إعطاء معلومات للعدو بهدف معاونته على فوز قواته في الحرب على لبنان ( ذلك بالرغم من كونه، حسب معلوماتنا، كان قد اعتقل قبل عدة أشهر من بدء العدوان الاسرائيلي على لبنان في تموز 2006) .
-        الدخول الى اسرائيل دون إذن ( وقد نفى السيد مقلد هذه المعلومة ويُلاحظ غياب أي دليل يُؤكد أو يَنفي هذه الجريمة في الملف)
-        التعامل مع جيش العدو.

من المُرجح أن يكونَ الحُكم البدائي قد تمّ على أساس إعترافات مُنتزعة تحتَ التعذيب.
إن هذه الإدعاءات تشكل في حال ثبوت صحتها، مُخالفات فاضِحة للإلتزمات الدولية للدولة اللبنانية وخرقاً للميثاق الدولي حول الحقوق المدنيّة والسياسيّة الموقّعة من قبل الدولة اللبنانيّة والذي يعلو بموجب الدستور اللبناني على القانون اللبناني.
نحن نُطالب السلطات المختصة بفتح تحقيق حول الإدعاءات المتعلقة بأعمال التعذيب وإصدار الأمر بإخضاع السيد مقلد للمعاينة وكشف من قبل طبيب عام وطبيب نفسي .

كما ونطلب الأخذ بعين الإعتبار جميع الإثباتات التي يمكن أن تؤكّد هذه الإدعاءات وإبطال الإعترافات المُوقعة خلال التحقيق الأولي، في حال ثبتت هذه الإدعاءات.

وأخيراً، تذكّر منظماتنا السلطات اللبنانية بواجبها بأن تضمنَ سلامة السيد مقلد الجسدية والنفسية وذلك بمنع أي محاولة لنقله الى أماكن احتجاز حيث يُمكن أن يتعرض فيها لأعمال عنف جسدي أو نفسي .

Allégations de détention illégale et de tortures dans l’affaire Moqalled

Les organisations signataires de cet appel expriment aux autorités politiques et judiciaires libanaises leur vive préoccupation concernant Monsieur Faysal Ghazi Moqalled, 32 ans, dont le procès en appel doit débuter le 24 novembre 2009 devant la cour d’appel du tribunal militaire de Beyrouth, et qui aurait été gravement torturé en vue de signer des aveux.

Selon les informations recueillies, Monsieur Moqalled aurait subi 5 mois de détention illégale dans une prison du Hezbollah (de février 2006 à juillet 2006), où il aurait subi des tortures en vue de lui faire avouer son appartenance présumée au Mossad israélien, avant d’être détenu durant 20 mois au Ministère de la Défense (jusqu’au 26 mars 2008), où il aurait à nouveau été gravement torturé.
Faysal Ghazi Moqalled souffre actuellement de douleurs au dos. Ses doigts ont été visiblement cassés, de même que six de ses dents de devant. Il souffre de plus d’un sévère traumatisme psychologique suite aux exactions qu’il aurait subies, notamment des chocs électriques, une simulation d’exécution au gaz, le balanco (les bras attachés dans le dos, la victime est suspendue au plafond à l’aide d’une poulie), la Falaqa (coups répétés sur la plante des pieds), des menaces de viol et différentes humiliations et privations graves.

Sa première audition par le juge d’instruction est datée du 5 août 2006. Monsieur Moqalled n’avait pas d’avocat, et, d’après nos informations, comme il s’était plaint d’avoir été torturé devant le juge d’instruction, il aurait subi de graves représailles de la part de ses geôliers, notamment en étant soumis à nouveau à la torture du balanco.

Le 31 juillet 2009, le tribunal militaire l’a condamné à la prison à perpétuité pour :
 - avoir donné des informations à l’ennemi en vue de l’aider à gagner la guerre (ceci alors qu’il était semble-t-il en détention plusieurs mois avant l’attaque israélienne contre le Liban en juillet 2006).
- être entré en Israël sans permission (l’intéressé nie cette information, et il semblerait qu’aucun élément probant ne permet de confirmer ou d’infirmer le crime)
- travailler avec l’armée ennemie

Il est très vraisemblable que la condamnation en première instance se base exclusivement sur des aveux signés sous la torture.

Ces allégations représentent, si elles sont avérées, des violations graves des engagements internationaux du Liban, en particulier du Pacte international relatif aux droits civils et politiques auquel le Liban est partie et qui, de par la constitution du pays, prime sur le droit national.

 Nous demandons aux autorités compétentes qu’une enquête soit ouverte sur les allégations de torture, notamment en ordonnant une expertise médicale et psychiatrique de l’intéressé et en considérant tous les éléments probants qui permettraient de vérifier les allégations, et que ses aveux signés au cours de l’enquête préliminaire soit invalidés si les allégations s’avèrent fondées.

Nos organisations rappellent également aux autorités libanaises leur obligation de garantir l’intégrité physique et psychologique de Monsieur Moqalled, notamment en prévenant toute tentative de le transférer vers des lieux de détention où il risquerait de faire l’objet de violences physiques ou psychologiques.

Allegations of illegal detention and torture in the case of Mr. Moqalled


The signatories of this appeal wish to express their deep concern to the Lebanese political and judicial authorities about Mr. Faysal Ghazi Moqalled, aged 32, whose trial on appeal shall begin on November 24, 2009 before the Court of Appeal of Beirut’s Military Tribunal. Mr. Moqalled has allegedly been severely tortured in view of making him sign confessions.

According to the information collected, Mr. Moqalled suffered 5 months of illegal detention in a Hezbollah prison (from February 2006 to July 2006), where he has been allegedly tortured to make him confess his assumed membership in the Israeli Mossad, before being detained for 20 months in the Ministry of Defense (until March 26, 2008), where he has been supposedly severely tortured once again.

Faysal Ghazi Moqalled is currently suffering from back pain. His fingers have been visibly broken as well as six of his front teeth. In addition, he suffers from a severe psychological trauma resulting from the exactions he was allegedly subjected to, including electric shocks, mock execution by gas, the balanco(arms tied behind his back, the victim is suspended from the ceiling using a pulley), the fallaqa (repeated blows on the soles of the feet), rape threats as well as various humiliations and serious deprivations.

His first hearing before the examining magistrate is dated August 5, 2006. MrMoqalled had no lawyer and, according to our information, has reportedly suffered serious reprisals from his jailers (including being subjected once more to the torture of balanco) as a result of complaining about being tortured before the examining magistrate.

On July 31, 2009, the military court sentenced him to life imprisonment for:

 - Giving information to the enemy in order to help the latter win the war (although he was apparently detained several months before the Israeli attack against Lebanon in July 2006).
- Entering Israel without permission (the person concerned denies this information, and there seems to be no conclusive evidence that can either confirm or refute this crime).
- Working with the enemy army.

It is very likely that the conviction in trial court is solely based on confessions signed under torture.

If confirmed, these allegations represent very serious violations of Lebanon's international commitments, in particular of the International Covenant on Civil and Political Rights to which Lebanon is a party and which stands above the national law according  to the country's constitution.

 We ask the competent authorities for an investigation into allegations of torture, including ordering a medical and psychiatric expertise of the person concerned. All the evidence that would verify the allegations should be considered and his confession signed during the preliminary investigation should be invalidated if the allegations are confirmed.

Our organizations would also like to remind the Lebanese authorities of their obligation to ensure the physical and psychological integrity of Mr. Moqalled, which include preventing any attempt to transfer him to places of detention where he might be subjected to physical or psychological violence.
